We certainly have to deal with a range of situations. This one concerns the claimed ‘abandonment’ of 27 birds of the parakeet family.
The owner of the birds had not been able to pay his rent and had been evicted. The owner of the property was feeding the birds properly. There was food and water, and the cages were spotless.
The owner of the birds said he had not abandoned his birds at all and would remove them if allowed to do so. The situation then became ugly, as when the truck arrived the owner of the property would not allow the birds to be taken away because money was owed him. At this stage the SPCA was called, but the owner of the birds had not willingly abandoned them, and this was not a case for us.
The owner of the property got a court interdict to stop the owner of the birds removing them until he had paid up. The issue ended up in court as a civil matter. The owner of the birds then phoned Jacqui to ask her to seize the birds, but she pointed out that this was entirely beyond the jurisdiction of the SPCA, as the birds were being well looked after..... more reports »
